Discharge of Lawsuit Judgments in Chapter 7 Bankruptcy
Dischargable. Most lawsuit judgments can be discharged in a Chapter 7 Bankruptcy, especially judgments for credit card debt, foreclosure deficiency, back rent and repossession deficits. ​
Not Dischargable. However, judgements for child support, alimony, equitable distribution, judgments affirming alleged fraud, judgments for injuries or damages caused by willful or malicious injury, and judgments for injuries or damages caused by drunk driving or driving under the influence of drugs are not dischargable in a Chapter 7 Bankruptcy. Although not dischargable under a Chapter 7, these judgments may be handled in a Chapter 13 Bankruptcy.
